The free trial provides Gold-tier features for 7 days. The trial automatically converts to a paid Gold subscription at the end of the trial period unless you cancel through your Apple ID subscription settings before the trial expires.

6.4 Subscription Renewal and Cancellation

  • Monthly and annual subscriptions renew automatically unless cancelled at least 24 hours before the end of the current billing period.
  • Cancellation is managed exclusively through your Apple ID settings in the App Store.
  • Upon cancellation, you retain access to paid features until the end of your current billing period.

6.5 Lifetime Purchases

Platinum and coFunder tiers are one-time purchases granting permanent access to their respective features. Refunds for lifetime purchases are handled exclusively by Apple under Apple’s refund policy.

6.6 Price Changes

We reserve the right to change subscription prices with at least 30 days advance notice. Price changes do not affect active subscription periods. Apple will notify you of any price changes and require your consent before renewal at the new price, as required by applicable law.

6.7 Downgrade Policy

If you downgrade to a lower tier or your subscription expires, the following applies to storage exceeding your new tier’s quota:

  1. Days 1-7: Grace period. Full access to all files. You may delete files or purchase additional storage.
  2. Days 8-14: Warning period. You will receive in-app and email notifications. Upload of new files is disabled.
  3. Days 15-21: Soft delete period. Files exceeding your quota are marked for deletion (oldest first, FIFO). You may still recover them by upgrading.
  4. After Day 21: Permanent deletion of excess files, oldest first, until usage is within your quota.

7. snab.cloud Storage

7.1 Storage Infrastructure

Files uploaded to snab.cloud are stored on Cloudflare R2 in the EU/Frankfurt region. All files are encrypted at rest using AES-256 encryption.

7.2 Storage Quotas

Each subscription tier includes a cloud storage allocation as specified in Section 6. Storage can be expanded with add-on purchases.

7.3 No Backup Service

snab.cloud is a cloud storage service for use within SNAB. It is not a backup service. We strongly recommend that you maintain your own backups of important files. While we take reasonable measures to protect your data, we cannot guarantee against data loss (see Section 15).

8. Referral Program

8.1 How It Works

You may invite others to SNAB using your unique referral code. When a new user signs up with your code:

  • You (referrer) receive 250 MB bonus cloud storage per successful referral, up to a maximum of 1 GB total bonus storage.
  • The invitee receives 100 MB bonus cloud storage.

8.2 Limits

  • Maximum 4 active referral invitations at a time.
  • Referral codes expire after 90 days if unused.

8.3 Abuse

Creating fake accounts, self-referrals, or any other manipulation of the referral program will result in revocation of all referral rewards and may lead to account suspension. We reserve the right to modify or discontinue the referral program at any time.

9. Theme Purchases

Themes are non-consumable in-app purchases that permanently customize the visual appearance of SNAB. Some themes are limited editions (maximum 1,000 units). Refunds for theme purchases are handled exclusively by Apple. If a theme purchase is refunded, the theme reverts to the default appearance.

10. User Content and Data Ownership

10.1 Your Content

You retain full ownership of all content you create, record, upload, or otherwise provide through SNAB (“User Content”). This includes voice recordings, documents, photos, text, and any other files.

10.2 No Rights Claimed

We do not claim any ownership rights or intellectual property rights over your User Content. AI-extracted items (tasks, events, reminders, insights, etc.) derived from your content are your property.

10.3 License to Operate

You grant us a limited, non-exclusive, non-transferable license to process, store, and transmit your User Content solely as necessary to provide and improve the SNAB service. This license exists only for the duration of your account and terminates upon account deletion.

10.4 Content Responsibility

You are solely responsible for your User Content. You represent that you have the necessary rights to any content you upload and that your content does not violate applicable law or third-party rights.

11. AI Processing Disclaimer

11.1 Automated Processing

Transcription, OCR, and action/insight extraction are automated AI processes. They may produce inaccurate, incomplete, or incorrect results. All AI processing runs on our self-hosted infrastructure in Germany. In standard operation, no third-party AI services are used.

11.2 No Guarantee of Accuracy

Extracted actions, insights, dates, times, reminders, and other structured data are suggestions. We do not guarantee their accuracy, completeness, or reliability. In particular:

  • Transcriptions may contain errors, especially with background noise, accents, or specialized terminology.
  • Date and time extraction from natural language is best-effort and may produce incorrect results.
  • Reminder scheduling depends on correct time extraction and is not guaranteed.
  • Insight detection and pattern recognition are approximations.

11.3 User Responsibility

You should always review AI-extracted items before relying on them for important decisions, deadlines, or commitments. We are not liable for consequences arising from reliance on AI-generated content without verification.

11.4 Continuous Improvement

We continuously work to improve extraction quality. However, we do not guarantee specific accuracy levels, and improvements may occasionally change extraction behavior.

12. Email Features

12.1 Personal Capture Address

Each user receives a personal email capture address in the format snab-{handle}-{token}@snab.email. This address is for capturing content into your SNAB account.

12.2 Inbound Email

Inbound emails are rate-limited according to your subscription tier. Only emails from verified senders are processed.

12.3 Outbound Email

SNAB may send outbound emails for reminders, scan delivery, voice memo delivery, and task summaries to the email recipients you configure.

12.4 Recycling

If your account is deleted, your personal email address may be recycled and assigned to a future user after a reasonable waiting period.

12.5 Limitations

We are not responsible for email delivery failures caused by factors beyond our infrastructure (e.g., recipient spam filters, DNS issues, third-party mail server outages). Email is encrypted in transit (TLS) and at rest, but is not end-to-end encrypted.

13. Cloud Provider Integrations

13.1 Optional Connections

You may optionally connect SNAB to third-party cloud storage providers (Google Drive, Dropbox, OneDrive, iCloud Drive). These connections are entirely optional and not required to use SNAB.

13.2 Access Scope

We store OAuth tokens to access your cloud storage on your behalf. We only access files and folders that you explicitly designate within SNAB.

13.3 Disconnection

You may disconnect any cloud provider at any time through the app settings. Disconnection immediately revokes our access. You may also revoke access directly through the third-party provider’s settings.

13.4 Third-Party Responsibility

We are not responsible for the availability, security, or data handling practices of third-party cloud providers. Their respective terms of service and privacy policies apply to your use of their services.

14. Apple Watch

The SNAB Apple Watch app is limited to voice recording functionality. It does not collect health data, location data, or biometric data. Recorded files are transferred to your paired iPhone for processing. Recording uses watchOS extended runtime sessions, which may be subject to system limitations imposed by Apple.

15. Acceptable Use

15.1 Prohibited Conduct

You agree not to:

  • Use SNAB for any purpose that violates applicable law or regulation.
  • Attempt to reverse-engineer, decompile, disassemble, or otherwise derive the source code of the app.
  • Abuse rate limits, circumvent tier restrictions, or exploit technical vulnerabilities.
  • Create fake accounts or manipulate the referral program.
  • Use the email feature for spam, phishing, unsolicited bulk messaging, or any form of mass communication.
  • Upload files containing malware, viruses, or other harmful code.
  • Impersonate another person or entity.
  • Interfere with or disrupt the operation of the service or its infrastructure.
  • Scrape, crawl, or automatically access the service in unauthorized ways.

15.2 Consequences

Violation of these rules may result in temporary suspension or permanent termination of your account, at our sole discretion. In cases of serious violations, we may report the conduct to the relevant authorities.

16. Service Availability

16.1 Availability Target

We aim for high availability of all SNAB services but do not guarantee uninterrupted or error-free operation. In particular:

  • Planned maintenance windows may cause temporary interruptions. We will endeavor to announce maintenance in advance where possible.
  • GPU-based processing (transcription, OCR, extraction) may experience queue times during peak usage.
  • Free-tier users may experience longer processing times than paid-tier users.

16.2 Modifications

We reserve the right to modify, update, suspend, or discontinue features of the service with reasonable notice. Material changes will be communicated via the app or email. We will provide at least 30 days notice before discontinuing core features.

16.3 Force Majeure

We are not liable for service interruptions caused by circumstances beyond our reasonable control, including but not limited to natural disasters, power outages, internet infrastructure failures, government actions, or pandemics.

17. Limitation of Liability

17.1 Unlimited Liability

In accordance with German law, we are liable without limitation for:

  • Damages caused intentionally or through gross negligence (BGB ss 276).
  • Damages to life, body, or health, regardless of the degree of fault (BGB ss 276, 278).
  • Liability under the German Product Liability Act (Produkthaftungsgesetz).
  • Liability arising from a guarantee expressly assumed by us (BGB ss 276, 443).

17.2 Limited Liability for Slight Negligence

For slight negligence (leichte Fahrlaessigkeit), we are liable only in the event of a breach of an essential contractual obligation (wesentliche Vertragspflicht / Kardinalpflicht). Essential contractual obligations are those whose fulfillment is necessary to achieve the purpose of the contract and on whose fulfillment you may reasonably rely. In such cases, liability is limited to the foreseeable, typically occurring damages (vertragstypisch vorhersehbare Schaeden).

17.3 Scope of Limited Liability

The foreseeable, typically occurring damage for SNAB services is limited to:

  • For monthly subscriptions: the amount of fees paid by you in the 12 months preceding the event giving rise to the claim.
  • For lifetime purchases: the one-time purchase price.
  • For free-tier users: EUR 50.

17.4 Exclusions

Subject to the unlimited liability provisions in Section 17.1, we are specifically not liable for:

  • Accuracy or completeness of AI-generated content, including transcriptions, extractions, and insights.
  • Data loss resulting from user error, device failure, or failure to maintain backups.
  • Outages or failures of third-party services (Apple, Google, Dropbox, Microsoft, Cloudflare).
  • Missed reminders, incorrect date or time calculations, or scheduling errors.
  • Data loss during cloud provider synchronization.
  • Damages arising from reliance on AI-extracted content without independent verification.

17.5 Vicarious Agents

The limitations in Sections 17.2 through 17.4 apply equally to claims against our employees, legal representatives, and vicarious agents (Erfuellungsgehilfen, BGB ss 278).

18. Intellectual Property

18.1 Our Property

The SNAB app, including its source code, design, user interface, brand, logo, extraction prompts, algorithms, and all related technology, is the intellectual property of MONNINGHOFF Labs UG (haftungsbeschraenkt). All rights are reserved.

18.2 License to Use

We grant you a limited, non-exclusive, non-transferable, revocable license to use the SNAB app on your personal devices in accordance with these Terms and the Apple Licensed Application End User License Agreement.

18.3 Restrictions

You may not copy, modify, distribute, sell, lease, or create derivative works based on the SNAB app or any part thereof, except as expressly permitted by applicable law (e.g., UrhG ss 69d, 69e for decompilation under limited circumstances).

18.4 Your Content

Your User Content remains your property as described in Section 10.

19. Privacy and Data Protection

The processing of your personal data is governed by our Privacy Policy, which forms an integral part of these Terms. By using SNAB, you acknowledge that you have read and understood the Privacy Policy.

Our data processing complies with the General Data Protection Regulation (GDPR / DSGVO) and the German Federal Data Protection Act (BDSG). Details on the legal bases for data processing, your data subject rights, and data retention periods are set out in the Privacy Policy.

20. Changes to These Terms

20.1 Notice

We may update these Terms from time to time. We will notify you of changes at least 30 days before they take effect via in-app notification, email, or a prominent notice on snab.app.

20.2 Acceptance

Your continued use of SNAB after the effective date of updated Terms constitutes your acceptance of the changes. If you do not agree to the updated Terms, you must stop using SNAB and delete your account.

20.3 Material Changes

For material changes that significantly affect your rights or obligations, we will seek your explicit consent where required by applicable law (BGB ss 305 ff.).

21. Term and Termination

21.1 Term

These Terms are effective from the date you first use SNAB and remain in effect until terminated.

21.2 Termination by You

You may terminate these Terms at any time by deleting your account through the app settings. Active subscriptions must be cancelled separately through your Apple ID settings in the App Store.

21.3 Termination by Us

We may terminate or suspend your account if you materially breach these Terms, in particular the Acceptable Use provisions in Section 15. Where possible, we will provide notice and an opportunity to cure the breach before termination, unless the breach is severe or ongoing.

21.4 Effect of Termination

Upon termination, your right to use SNAB ceases immediately. Your data will be deleted from our systems within 30 days, unless retention is required by law (e.g., tax record retention obligations under AO ss 147). Provisions that by their nature should survive termination (including Sections 10, 17, 18, and 20) will continue to apply.

22. Governing Law and Jurisdiction

22.1 Governing Law

These Terms are governed by the laws of the Federal Republic of Germany, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG).

22.2 Consumer Protection

If you are a consumer within the meaning of BGB ss 13, the mandatory consumer protection laws of your country of habitual residence apply in addition, to the extent they provide greater protection than German law.

22.3 Jurisdiction

For disputes with merchants (Kaufleute) or legal entities, the exclusive place of jurisdiction is Muenster, Germany. For consumers, the statutory places of jurisdiction apply (ZPO ss 12 ff.).

22.4 EU Online Dispute Resolution

The European Commission provides an online dispute resolution platform at https://ec.europa.eu/consumers/odr/.

We are neither obligated nor willing to participate in dispute resolution proceedings before a consumer arbitration board (Verbraucherstreitbeilegungsgesetz ss 36 Abs. 1).

23. Severability

If any provision of these Terms is held to be invalid, unenforceable, or void, the remaining provisions shall remain in full force and effect. The invalid provision shall be replaced by a valid provision that most closely achieves the economic purpose intended by the parties (BGB ss 306).

24. Final Provisions

24.1 Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and MONNINGHOFF Labs UG regarding your use of SNAB. They supersede all prior agreements and understandings.

24.2 No Waiver

Our failure to enforce any provision of these Terms does not constitute a waiver of that provision or our right to enforce it in the future.

24.3 Assignment

You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations to a successor entity in the event of a merger, acquisition, or sale of assets, provided the successor assumes all obligations under these Terms.

24.4 Language

These Terms are drafted in English. In the event of any discrepancy between language versions, the English version prevails.
